Delhi-NCR is witnessing a heated debate after the Supreme Court issued a directive to remove all stray dogs from the streets and relocate them to shelters within eight weeks. While the order is aimed at tackling the rising number of dog bite incidents, it has ignited a wave of protests, legal debates, and concerns over animal welfare.


The Supreme Court’s August 11 Order

A bench led by Justices JB Pardiwala and R Mahadevan instructed that all stray dogs across Delhi-NCR be captured and kept in designated shelters. Authorities were told:

  • No Re-Release: Once captured, dogs must not be returned to the streets.
  • Strict Monitoring: Helplines, CCTV surveillance, and daily tracking of captures should be implemented.
  • Penalties: Obstructing the process could lead to contempt proceedings.

This decision came after a surge in dog bite cases, including a tragic incident involving a six-year-old girl. Reports indicate that Delhi has seen tens of thousands of dog bite incidents in 2025 alone, prompting urgent calls for action.


Why the Order Was Issued

The directive was largely motivated by public safety concerns:

  • Rising Dog Bite Cases: Data shows a worrying increase in bites, some leading to rabies — a disease still claiming thousands of lives in India annually.
  • Urban Public Safety: The court cited the need to protect vulnerable populations, including children and the elderly.

The Pushback

The decision has been met with strong opposition from activists, experts, and ordinary citizens. Critics argue:

  1. It Contradicts Existing Laws
    India’s Animal Birth Control (ABC) Rules, 2023 mandate sterilization, vaccination, and returning dogs to their original locations — not permanent removal.
  2. Practical & Financial Hurdles
    Relocating and caring for an estimated 1 million stray dogs could cost up to ₹15,000 crore and require massive infrastructure.
  3. Ethical Concerns
    Animal welfare groups have condemned the order as inhumane, calling it a “death sentence” for street dogs.
  4. Health Risks
    Experts warn of the “vacuum effect,” where removing dogs could disrupt ecosystems, increase aggression among remaining strays, and worsen zoonotic disease spread.

Public & Celebrity Protests

Protests have erupted across Delhi, with demonstrators gathering at India Gate and Connaught Place. Police detained several protesters.
Celebrities, including actors and comedians, have joined the cause, urging for more compassionate and sustainable solutions.


CJI’s Response

On August 13, Chief Justice B.R. Gavai responded to a plea highlighting contradictions with previous court orders. In May 2024, another bench had ruled against indiscriminate killing or removal of community dogs, emphasizing compassion.

CJI Gavai remarked, “I will look into it,” signaling that the Supreme Court may review the August 11 directive.

The matter could return to the court for reconsideration. Animal rights advocates hope for a ruling that aligns with ABC laws, balances public safety, and upholds compassion for street animals.
